This image is public domain and not under copyright for a variety of reasons:
It was made for evidence during a trial, created by govt. entity with taxpayer money, not eligible for copyright.
It is sufficiently old that if it were created with the intention of being copyrighted in the US that it needed to be distributed with a clear copyright notice, which it didn't have.
It is also sufficiently old that if it were intended to be under copyright and had a proper copyright notice that it would have also had to have been renewed to still be covered at copyright at this late date, which it couldn't have been, especially considering the points above.
Note that it may still be copyrighted in jurisdictions that do not apply the rule of the shorter term for US works (depending on the date of the author's death), such as Canada (50 p.m.a.), Mainland China (50 p.m.a., not Hong Kong or Macao), Germany (70 p.m.a.), Mexico (100 p.m.a.), Switzerland (70 p.m.a.), and other countries with individual treaties.
